Cancellation (Article 5)
These terms apply to bookings we have taken directly (an application through this site, or a payment link sent by us).

Days are counted backwards with the check-in date as "the day itself" and the day before it as "one day before" (Japan time).
With only two rooms, a late cancellation is one we can almost never offer to another guest. That is why cancellation up to 8 days before is free of charge.
If public transport is suspended because of a weather warning or the like, we will discuss a change of dates or a refund with you individually.
Bookings made through a travel site are governed by the cancellation policy of the site where you actually made the booking. The booking services we contract with and manage directly are Vacation STAY and Airbnb. Plans listed on Booking.com, Rakuten Travel, Agoda and the like are offered as distribution partners of Vacation STAY, and bookings from those sites also reach us through Vacation STAY.
Article 1 (Scope)
- The accommodation contract and related contracts entered into between the guest house (GUEST HOUSE ARASHIMA, "we" or "the guest house") and the guest staying with us ("the guest") are governed by these terms. Matters not provided for in these terms are governed by law or by generally established practice.
- Where we have agreed to a special arrangement within the bounds of law and practice, that arrangement takes precedence.
- For bookings made through a travel reservation site or similar, the cancellation policy and other conditions set by that site apply in priority. Articles 5 and 11 apply to bookings we have taken directly ("direct bookings").
Article 2 (Application for an accommodation contract)
- A person applying to us for an accommodation contract shall state the following.
- The guest's name, address, and contact details (including a mobile number able to receive SMS on the day)
- The dates of stay and the expected time of arrival
- The number of guests
- Any other matter we consider necessary
- Where a guest asks during their stay to continue beyond the dates in item 2 of the preceding paragraph, we treat that request, at the moment it is made, as an application for a new accommodation contract.
Article 3 (Conclusion of the accommodation contract)
- The accommodation contract is concluded when we accept the application under the preceding article. This does not apply where we prove that we did not accept it.
- Once the accommodation contract is concluded under the preceding paragraph, the guest pays the full amount of the room charge by the deadline we set (payment in advance).
- The sum paid under the preceding paragraph is applied first to any cancellation charge payable if the guest cancels the contract, then to any compensation; any balance is returned at settlement.
- If the guest does not pay by the deadline in paragraph 2, the accommodation contract ceases to have effect. This applies only where we have specified a payment deadline and notified the guest of it.
- For our direct bookings, the payment link is valid for 30 minutes from issue. If payment is not confirmed within that time, the booking is not concluded.
Article 4 (Refusal to conclude an accommodation contract)
We may decline to conclude an accommodation contract in the following cases.
- Where the application does not comply with these terms
- Where there is no room available
- Where the person seeking to stay is considered likely to act, in connection with the stay, in breach of the law, public order, or good morals
- Where the person seeking to stay is considered to be a member of an organised crime group, an affiliated business or organisation, a related person, or another anti-social force
- Where the person seeking to stay has behaved in a way that seriously disturbs other guests or the neighbourhood
- Where the person seeking to stay is clearly considered to be suffering from a communicable disease
- Where a burden beyond a reasonable scope has been demanded in connection with the stay
- Where we are unable to accommodate the guest because of a natural disaster, a failure of the facilities, or another unavoidable cause
- Where the number of people applying exceeds the capacity of the room (three per room)
- Where a case provided for by an ordinance of Mie Prefecture or Toba City applies
Article 5 (The guest's right to cancel)
This article applies to direct bookings. Bookings made through a travel site are governed by the rules of that site.
- The guest may cancel the accommodation contract by telling us so.
- Where the guest cancels all or part of the accommodation contract for reasons attributable to them, we charge the cancellation fee set out in the table at the top of this page.
- Days are counted backwards with the check-in date as "the day itself" and the day before it as "one day before". Times are in Japan Standard Time.
- Shortening the stay or reducing the number of guests is also treated, as to the part reduced, as a cancellation under the preceding paragraph, and the same rates apply. Because our rate increases with the number of guests, no reduction is made for a decrease in guests from 7 days before check-in onwards.
- Refunds are made to the payment method used. Any fee incurred in making the refund is borne by us.
- Where we have specified a payment deadline under Article 3(2) and notified the guest of it, and the guest cancels before making that payment, we charge a cancellation fee only where we can prove that we gave that notice.
- Where the guest does not arrive by 23:00 on the check-in date without contacting us (or, where an expected arrival time has been stated in advance, by two hours after that time), we may treat the accommodation contract as having been cancelled by the guest.
- Notwithstanding the preceding paragraphs, where public transport to the guest house is suspended because of a weather warning or another disaster, we will discuss a change of dates or a refund with you individually. Please contact us and show us material confirming the suspension.
Article 6 (Our right to cancel)
- We may cancel the accommodation contract in the following cases.
- Where the guest is considered likely to act, or to have acted, in connection with the stay, in breach of the law, public order, or good morals
- Where the guest is considered to be an anti-social force
- Where the guest is clearly considered to be suffering from a communicable disease
- Where we are unable to accommodate the guest because of force majeure such as a natural disaster
- Where the guest allows more people to stay than were notified to us, or lets a person who was not notified enter the room
- Where the guest does not comply with smoking in the bedrooms, tampering with fire-fighting equipment, or other prohibitions in the house rules we set (limited to those necessary for fire prevention)
- Where the guest makes violent demands or requires a burden beyond a reasonable scope
- Where we cancel the accommodation contract under the preceding paragraph, we do not charge for accommodation services the guest has not yet received. However, where the cancellation is under items 1, 2, 5, 6, or 7 of the preceding paragraph, the room charge already paid is not refunded.
Article 7 (Registration)
- By the day of the stay, the guest shall notify us of the following.
- The guest's name, address, contact details, and occupation
- For a foreign national without an address in Japan, nationality, passport number, and submission of a copy of the passport
- Any other matter we consider necessary
- We compile and keep a guest register in accordance with the Private Lodging Business Act and its enforcement regulations.
- The guest house is unstaffed, and in place of identity checks in person we verify identity from information submitted in advance together with ICT (video and still images). Where the required submissions are not made, we may cancel the accommodation contract under Article 6.
Article 8 (Hours of use of the room)
- The guest may use the room from 15:00 on the day of check-in until 23:00, and until 11:00 the following morning for check-out. On consecutive nights, however, the room may be used all day except on the day of arrival and the day of departure.
- Notwithstanding the preceding paragraph, we may agree to use of the room outside those hours. In that case an additional charge may apply.
- We are unable to store luggage before check-in or after check-out. If you have particular circumstances, please ask us in advance by SMS. We may be able to offer an earlier check-in.
Article 9 (Compliance with the house rules)
The guest shall comply with the house rules that we set and display. In particular, the following are to be observed.
- The whole building, all rooms, and the common areas (including corridors and stairs) are non-smoking.
- The guest house is an apartment. After 22:00, please be especially considerate about voices, noise, and the sound of the bathroom being used.
- People who have not been notified to us may not stay or enter, and the room may not be sublet.
- Please do not disclose the door code to any third party.
- Please refrain from using open flames, bringing in dangerous goods, or bringing pets.
- Please separate your rubbish as we instruct.
Article 10 (Hours of business and contact)
- The guest house is unstaffed and has no permanently attended front desk.
- Enquiries are taken by telephone (+81 90-3258-2790) and by SMS. At night and at certain other times, a reply may not come until the following day.
- The door code for the room is sent by SMS by the day of the stay. Where no mobile number able to receive SMS has been registered, we cannot provide a means of entry. In that case we may cancel the accommodation contract under Article 6.
Article 11 (Payment of charges)
- The breakdown of the room charge is as shown in the statement we provide and as displayed by the travel site. The room charge includes consumption tax and the Toba City accommodation tax (where it does not, we state so).
- The room charge is paid by credit card or another method we specify, in full and before the stay.
- The room charge is payable even where the guest voluntarily does not stay after we have provided the room and it has become available for use.
Article 12 (Our liability)
- Where we cause loss to the guest in performing, or failing to perform, the accommodation contract or a related contract, we compensate that loss. This does not apply where the loss did not arise from a cause attributable to us.
- We carry the insurance required of a private lodging business operator.
Article 13 (Where the room contracted for cannot be provided)
- Where we cannot provide the guest with the room contracted for, we will, with the guest's consent, arrange other accommodation on conditions as close as possible to the same.
- Where no other accommodation can be arranged, we refund the full room charge already paid. However, where the inability to provide the room did not arise from a cause attributable to us, no compensation payment is made.
Article 14 (Deposited property)
- We do not accept luggage or valuables for safekeeping.
- Property left behind by a guest on the premises is kept by us for seven days from the day it is found, after which it is reported to the police station with jurisdiction or disposed of. Food, drink, and other items unsuited to storage are disposed of on the day they are found.
Article 15 (Liability for parking)
The guest house has no car park. Where the guest uses a nearby car park, we accept no responsibility whatsoever for the management of the site or of the vehicle. Please check the signage on site for charges, opening hours, and the like.
Article 16 (The guest's liability)
Where we suffer loss through the guest's intent or negligence, that guest shall compensate us for it. In particular, for smoking in the bedrooms, for soiling that requires a cleaning contractor to restore the room, and for damage to fittings, we charge the actual cost together with an amount equivalent to the room charge for the period during which the room cannot be sold.
Article 17 (Language)
The Japanese text of these terms is the authoritative version. Where there is any discrepancy with a version in another language, the Japanese text prevails.
Article 18 (Governing law and jurisdiction)
These terms are governed by and construed in accordance with the law of Japan. The Tsu District Court shall be the exclusive court of first instance by agreement for any dispute concerning these terms.
